This document outlines our agreement (“Agreement”) regarding the use of our website, referring to you as the “User.” The services we offer will be termed as “Service,” and any vendors you may interact with will be called “Vendor.”
Gracious Photography is a platform designed to facilitate communication between Users and Vendors, specifically for wedding-related services. Our role is to provide a space where Vendors and prospective purchasers of wedding services can exchange information, with the aim of forming business relationships. However, Gracious Photography does not guarantee that Users will find a suitable Vendor through our platform. Furthermore, we do not engage in or guarantee the completion of any agreements between Users and Vendors. It is the User’s sole responsibility to evaluate the integrity, honesty, experience, capability, and reliability of any Vendor they communicate with through our website.
The presence of any Vendor on our website does not imply an endorsement of their services by Gracious Photography. We do not verify the qualifications of any Vendor, nor do we endorse any statements made by Vendors on our website or in communications with Users. Gracious Photography does not screen potential Vendors.
Users should understand that Gracious Photography is not liable for any disputes, claims, controversies, or lawsuits arising between Users and Vendors from the use of this website and Service.
While Users do not incur any fees for using our Service, Vendors do pay a fee to Gracious Photography for the opportunity to solicit business from Users.
By signing up for Graciousphotography.com, you consent to receive communications from us electronically and by phone regarding offers or other website-related information. Occasionally, we may send text message offers and alerts. By agreeing to these terms, you authorize Graciousphotography.com (Online Wedding Gracious Photography) to send text messages to your mobile device with new wedding notifications and special offers. Standard text messaging rates will apply to any messages received.
Users agree that Gracious Photography is not responsible for any harm resulting from the use of this Service. Users unconditionally agree to indemnify and hold Gracious Photography fully harmless from any liability arising from or in connection with the content or use of the Service. This indemnification includes, but is not limited to, attorney’s fees and costs.
Gracious Photography reserves the right to modify this Agreement at any time and may discontinue the website without notice. We also reserve the right to change our company name and domain name at any time, with all existing contracts carrying over to the new name. Users agree that Gracious Photography shall not be liable to them or any third party for any modifications or discontinuance of the Service. Users acknowledge that any termination of Service may occur without prior notice, and Gracious Photography may immediately delete data and files in the User’s account, barring further access.
Users expressly agree that the use of the Service is at their own risk. The Service is provided on an “as is” basis. Gracious Photography disclaims all warranties, whether expressed or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. We do not guarantee that the Service will meet Users’ requirements or that it will be uninterrupted, timely, secure, or error-free. Furthermore, we do not warrant the accuracy or reliability of any information obtained through the Service or guarantee that defects will be corrected. Gracious Photography makes no warranty regarding any goods or services purchased through the Service or any transactions entered through the Service. No advice or information obtained from Gracious Photography shall create any warranty not expressly stated herein.
The User Profile Review is an open forum where past clients can leave reviews about their experiences with Vendors. These reviews are generally unfiltered and permanent unless deemed vulgar or slanderous. Vendors can dispute unwanted reviews by notifying Graciousphotography.com, which reserves the right to moderate and either accept or reject the review.
Gracious Photography shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service, including damages arising from interactions with Vendors. Additionally, we are not liable for any damages arising from the interruption, suspension, or termination of the Service, whether such actions were justified, negligent, or intentional.
Any claims or disputes arising from this Agreement shall be resolved under the laws of the State of California and subject to arbitration conducted in Orange County, California. Any court with jurisdiction may enter judgment on the arbitration award.
If any part of this Agreement is found to be invalid, illegal, or unenforceable, the parties intend for the provision to be modified to render it valid and enforceable to the fullest extent permitted by law. The remaining provisions shall remain fully valid and enforceable.
